The European Commission’s anti-tax avoidance package

The European Commission has published its ambitious anti-tax avoidance package. Heather Corben (King & Wood Mallesons) reviews the proposals.
 
What is the Commission’s approach?
 
The Commission has stated that it has published this package as the next step in clamping down on corporate tax avoidance and ensuring fair taxation in the EU. It sees its approach as resting on what it describes as ‘three key pillars’: 
  • first effective taxation (so that all companies pay taxes where they make their profits); 
  • second tax transparency (so that member states have the information needed to ensure fair taxation); and 
  • third addressing the risk of double taxation (so that companies which pay their ‘fair share’ of taxes are not penalised for making use of the EU’s internal market).
