The Law Commission published its long-awaited report on updating and modernising the law governing the making of valid wills.
The current law which is used to determine the validity of a will is the Wills Act 1837 which inevitably needs serious updating. Questions of remote witnessing of wills became especially relevant during the era of lockdowns and it will be recalled that temporary legislation was introduced to enable a valid will to be made where two people witnessed a will using live action video witnessing.
