The Tribunal Procedure (Amendment) Rules SI 2025/561 expressly empower the Upper Tribunal and First-tier Tribunal to set aside a previous decision they have made (i.e. without requiring an application to set aside from one of the parties). The power to set aside its own previous decision where there has been a procedural irregularity is already available to the tribunals. The change here is to allow the tribunal to do so of its own volition rather than only where a party makes an application. The change applies from 30 May 2025.
